Welcome to NGCEats. These Terms of Use ("Terms") govern your access to and use of the NGCEats website, mobile application, and related services (collectively, the "Platform").
The Platform is owned and operated by Niraj Global Corporation, a firm registered at 0, 0, Ragar Mohalla, MD 34, Shri Balaji E Mitra and Book Depot, Ragar Mohalla, Nohar, Hanumangarh, Rajasthan, 335523, India ("Company", "we", "us", or "our").
By downloading, installing, or accessing the Platform, you explicitly agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
1.1. NGCEats acts purely as an intermediary technology platform connecting users ("Buyers") with independent third-party food vendors ("Restaurant Partners") and independent delivery personnel ("Delivery Partners").
1.2. We do not own, sell, resell, furnish, provide, prepare, or manage any food or beverage products. The sole responsibility for the quality, safety, ingredients, and preparation of the food lies with the respective Restaurant Partner.
2.1. To use our services, you must register and create an account by providing accurate information (Name, Phone Number, Delivery Address).
2.2. You are solely responsible for maintaining the confidentiality of your account credentials and OTPs. NGCEats will not be liable for any unauthorized use of your account.
3.1. All food prices listed on the Platform are determined by the Restaurant Partners. Prices may fluctuate without prior notice. The prices shown on the app may differ from the dine-in prices at the physical restaurant.
3.2. Delivery fees, platform fees, and applicable government taxes (e.g., GST) will be explicitly displayed on the checkout page before you confirm the order.
4.1. NGCEats offers multiple payment options, including Credit/Debit Cards, UPI, Wallets, and Net Banking, processed through a secure third-party gateway (Razorpay).
4.2. Cash on Delivery (COD) Conditions: While we offer COD for customer convenience, it is strictly governed by the following rules to prevent abuse and ensure rider safety:
5.1. Customer Cancellation: To ensure fast service and prevent food wastage, all orders placed on the Platform are final. As explicitly stated on our checkout page, once an order is successfully placed, it cannot be modified or cancelled by the customer. Orders are strictly non-refundable.
5.2. NGCEats Cancellation: We reserve the right to cancel your order in unforeseen circumstances, such as item unavailability, restaurant closure, or unserviceable delivery locations. In such rare cases, if you have prepaid, a 100% refund will be initiated to your NGCEats Wallet or original payment source within 3-5 business days.
6.1. Money loaded into the NGCEats Wallet is non-transferable to bank accounts and can only be used to purchase food and services within the NGCEats ecosystem.
6.2. Gift Cards generated on the platform possess a unique 12-digit code and 4-digit PIN. NGCEats is not responsible if a user shares their PIN with unauthorized third parties resulting in the loss of Gift Card value.

Violation of these rules will result in an immediate and permanent ban from the Platform.
8.1. NGCEats is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our Platform.
8.2. We do not guarantee that the delivery will be completed exactly within the estimated delivery time, as factors like traffic, weather, and restaurant preparation delays are beyond our control.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Nohar, Hanumangarh, Rajasthan.
